On December 1, 2016, a Texas jury awarded $1 billion in punitive damages against Johnson & Johnson in a products liability case in which the jury found that the corporate giant had manufactured and sold a hip implant device even though it knew the device was defective and could cause injury. The federal judge who presided over the trial has now reduced the punitive damage award by nearly one-half, to approximately $510 million. The punitive damages are awarded in addition to the jury’s compensatory damage award to each of six plaintiffs. The trial judge reasoned that a Utah case decided a decade ago by the United States Supreme Court limits the amount of a punitive damage award to nine times the amount of a plaintiff’s compensatory damage award. Compensatory damages are the amount awarded to compensate a plaintiff for his or her actual out-of-pocket losses, including permanent pain and suffering. Both sides have stated they intend to appeal various rulings in the case.
